Family-Based Green Card for a Brother or Sister
A U.S. citizen who is at least 21 years old may file Form I-130, Petition for Alien Relative, for an eligible brother or sister to begin the family-based immigration process.
Lawful permanent residents (Green Card holders) cannot petition for their siblings.
Family Fourth Preference – F4
Brothers and sisters of U.S. citizens are classified under the Family Fourth Preference (F4) category.
Because F4 is a family-preference category subject to annual immigrant visa limits, approval of Form I-130 does not mean that an immigrant visa is immediately available. The beneficiary generally must wait until their priority date becomes current before completing the immigrant visa process.
How the Process Begins
The U.S. citizen petitioner files Form I-130 with USCIS and provides evidence establishing the qualifying sibling relationship.
After USCIS receives the petition, it generally issues a receipt notice and later provides a decision or requests additional information if necessary.
After Form I-130 Is Approved
Once USCIS approves the petition, the case may be transferred to the National Visa Center (NVC).
Because sibling petitions are subject to visa availability, the case proceeds to immigrant visa processing when the beneficiary’s priority date becomes eligible under the applicable Visa Bulletin.
An eligible spouse and unmarried children under 21 of the principal beneficiary may generally qualify as derivative beneficiaries in the F4 category.
Financial Sponsorship
During the immigrant visa stage, the petitioner generally must submit an Affidavit of Support, Form I-864, accepting financial responsibility for the intending immigrant.
If the petitioner’s income does not meet the applicable financial requirements, an eligible joint sponsor may also be used, while the petitioner generally remains required to submit their own Affidavit of Support.
Important
Approval of Form I-130 does not automatically grant a Green Card or guarantee approval of an immigrant visa.
Sibling petitions may involve significant waiting periods because the F4 category is subject to annual visa limits and priority-date availability.
