2. Legal Freedom to Marry: Both partners must be legally free to marry. Any previous marriage(s) must have been legally terminated.
3. In-Person Meeting: Generally, couples must have met in person at least once during the two years before filing the petition, although limited exceptions may apply.
4. Genuine Relationship: Applicants must provide evidence of their relationship and their intention to marry.
5. 90-Day Marriage Requirement: The couple must intend to marry within 90 days of the foreign fiancé(e)’s admission to the United States on a K-1 visa.

WHAT DOES THE K-1 VISA PROCESS INVOLVE?

The process generally includes:

• Filing Form I-129F with USCIS.
• Case processing through the National Visa Center (NVC).
• Completing Form DS-160 and preparing the required documentation.
• Completing the required medical examination and attending the consular interview.
• Traveling to the United States after visa issuance and admission authorization.
• Getting married within 90 days of admission.
• Applying for Adjustment of Status (Green Card) after marriage, if eligible, through a separate application process.
