U.S. CITIZENS PETITIONING FOR THEIR PARENTS

U.S. CITIZENS PETITIONING FOR THEIR PARENTS

Bringing Families Together, One Step at a Time!

Family is one of life’s greatest treasures, and being reunited with your parents can be an incredibly meaningful experience.

Are you a U.S. citizen hoping to bring your mother, father, or both parents to live permanently in the United States?

U.S. immigration law allows eligible U.S. citizens who are at least 21 years old to petition for their parents to become lawful permanent residents (Green Card holders).

WHAT SHOULD YOU KNOW BEFORE STARTING THE PROCESS?

  1. U.S. Citizenship: You must be a U.S. citizen and at least 21 years old to petition for your parents. Lawful permanent residents cannot petition for their parents.
  2. Qualifying Family Relationship: You must provide documentation establishing the qualifying parent-child relationship.
  3. Form I-130: A separate Petition for Alien Relative must be filed for each parent you wish to sponsor.
  4. Immediate Relative Category: Parents of U.S. citizens age 21 or older are classified as immediate relatives. This means they are not subject to annual immigrant visa numerical limits. However, petition processing and other immigration requirements still apply.
  5. Financial Sponsorship: In most cases, the U.S. citizen petitioner must submit Form I-864, Affidavit of Support, along with the required financial documentation during the appropriate stage of the process.

WHAT DOES THE IMMIGRATION PROCESS INVOLVE?

The steps depend on whether your parents live outside or inside the United States.

PARENTS LIVING OUTSIDE THE UNITED STATES

The process generally includes:

  • Filing Form I-130 with USCIS.
  • National Visa Center (NVC) processing after petition approval.
  • Completing Form DS-260, the immigrant visa application.
  • Preparing Form I-864 and supporting financial documents.
  • Submitting the required civil and supporting documentation.
  • Completing a medical examination and attending a consular interview.
  • Traveling to the United States after immigrant visa approval and issuance.

PARENTS CURRENTLY IN THE UNITED STATES

Parents who are already in the United States may qualify to apply for Adjustment of Status through Form I-485, depending on their individual immigration circumstances and applicable eligibility requirements.

Important: Approval of Form I-130 does not automatically grant permanent residence or authorize a parent to remain in the United States.
